Promotion Terms

These Promotion Terms apply to all competitions, discounts, referral programs, giveaways, and other promotional offers (collectively, “Promotions”) made available by Archies Footwear LLC (“Archies Footwear,” “we,” “us,” or “our”). By participating in, accessing, or redeeming any Promotion listed below, you agree to be bound by these Promotion Terms, our Terms of Use & Sale, and our Privacy Policy, each of which is incorporated herein by reference. Additional terms may apply to specific Promotions and, in the event of any inconsistency, those additional terms will control to the extent necessary to resolve the inconsistency.

Monthly Post Purchase Survey Competition - Official Rules 

Please note that for items marked as clearance, returns or exchanges will only available for a store credit only to the value of the item at the time of purchase. For any warranty claims on clearance items a replacement item in any available colour-way equal to the non discounted price will be available. Please note that there is no free shipping for clearance items.

Eligibility
The competition is open to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at the time of entry. 

How to Enter
To enter, participants must:

1. Make a purchase on archiesfootwear.com during the Competition Period;
   

2. Complete the Post-Purchase Survey provided after their purchase; and
   

3. Answer the following question in 50 words or less:
   “Tell us one thing you’d love to see from Archies Footwear in the future.”
   

Participants may submit one (1) entry per purchase during the Competition Period. Responses must adhere to the word limit and be the participant’s original work.

Judging Criteria
Entries will be judged based on the following criteria: Creativity (50%), Relevance to the question (30%), Clarity of expression (20%)

The decision of the judges is final, and no correspondence will be entered into regarding the outcome. Entries that exceed the word limit, contain inappropriate content, or do not address the question will be disqualified.

Prize Details
One (1) winner will receive one (1) pair of Arch Support Flip Flops in the winner’s choice of color and size, to the value of $40 (USD), plus shipping.

The prize:

• Must be redeemed within ten (10) business days from the date of the winner's notification.
  

• Cannot be exchanged for cash or any other product.
  

• Is subject to availability of the selected color and size at the time of redemption. If the selected color or size is unavailable, the Sponsor will offer alternative options of equal or lesser value.
  

Competition Period
The competition runs monthly, with each Competition Period starting at 12:01am EST on the first calendar day of the month and closing at 11:59pm EST on the last calendar day of the same month.

Winner Selection
The winner will be selected by a panel of judges based on the stated judging criteria. Judging will take place at Level 1, 101 Moray Street, South Melbourne, Australia, at 3:00pm AEDT on the first business day of the following month.

The winner will be notified via email within five (5) business days of judging. If the winner does not claim the prize within the redemption timeframe, the Sponsor reserves the right to select an alternative winner.

Delivery of Prize
The prize will be shipped to the winner’s nominated address within the 50 United States and the District of Columbia. Delivery is included as part of the prize.

Privacy
Personal information collected through this competition is handled in accordance with Archies Footwear’s Privacy Policy, available here. By entering the competition, entrants consent to their personal information being used for the purpose of administering the competition and, where agreed, for marketing communications. Entrants located in California have additional rights under the California Consumer Privacy Act (CCPA). For more information, refer to our Privacy Policy.

Liability
The Sponsor is not responsible for:

• Lost, delayed, or misdirected entries due to technical disruptions or network issues.
  

• Any tax liability incurred by the winner.
  

• Any claims, damages, injuries, or losses arising from participation in the competition or use of the prize.
  

The Sponsor’s decision regarding any aspect of this competition is final and binding, and no correspondence will be entered into.

Governing Law
This competition is governed by the laws of the State of California. All disputes arising from this competition will be resolved in accordance with the laws of California, and entrants agree to submit to the jurisdiction of the courts of California.

2) Offer Summary

Eligible customers may receive $10 USD off eligible Slides purchases of at least $60 USD, excluding shipping, taxes, duties, and other fees.

This offer applies to Slides only and does not apply to any other products unless expressly stated by the Company in writing.

3) Promotion Period

This promotion is offered on an ongoing basis through selected CRM/email flows and remains available until withdrawn, modified, or replaced by the Company.

A unique Promotional Code is automatically generated when the promotional email is sent to an Eligible Customer.

Each Promotional Code:

• is issued only to the Eligible Customer who receives the email;

• is valid for seven (7) days from the time the email is sent; and

• becomes inactive and invalid if not redeemed within that 7-day period.

The Company is not responsible for delays caused by email providers, spam filters, customer device settings, or similar factors outside its reasonable control.

If there is any discrepancy between the email delivery time, displayed expiry messaging, and the Company’s internal systems, the send time and expiry recorded in the Company’s systems will govern, to the extent permitted by law.

Promotional Codes must be redeemed before the stated end time to be valid.

End/expiry: The code must be redeemed before expiry to be valid.

• If there is any discrepancy between the displayed time and the Send Time, the Send Time in Company’s systems will apply, where permitted by law.
  
  

• Company is not responsible for delays caused by email providers, spam filters, or customer device settings.
  

4) Definitions

For clarity in these Terms:

• “Eligible Customer” means an individual who: (a) received the promotional email from Company at the relevant email address; and (b) meets the eligibility criteria in section 5 at the time the promotional email is sent.
  
  

• “Promotional Code” means the unique single-use code delivered to an Eligible Customer via email.
  
  

•  Slides” means products designated and displayed as “Slides” on https://archiesfootwear.com/ at the time of purchase.
  
  

5) Eligibility Criteria

This offer is available only to selected customers who received the promotional email. 

To be an Eligible Customer, you must reasonably meet all of the following at the time the promotional email is sent:

1. You have placed at least one (1) previous order with Company; and
   
   

2. You are subscribed to Company’s email marketing; and
   
   

3. You have not previously purchased slides (as reasonably determined by Company order history associated with your account/email address).
   
   

Company may verify eligibility by referencing your account, email address, order history, and related identifiers reasonably used for fraud prevention and promotion integrity.

Exclusions

Unless required by law, the offer is not available to:

• employees, contractors, or agents of Company (and their immediate families/households), if applicable; or
  
  

• customers who are not able to be verified as Eligible Customers by Company’s systems.

Good Faith

If we identify you as an Eligible Customer in error, we will honour any promotional code sent to you.

6) Redemption Conditions

Where valid

• Not valid in physical stores, marketplaces, third-party retailers, or other domains unless expressly stated.
  
  

How to redeem

• Enter the Promotional Code at checkout during the Promotion Period.
  
  

• The discount will apply if all conditions are satisfied.
  
  

Purchase requirement and minimum spend

• The discount applies to one (1) pair of slides only, in one (1) transaction.
  
  

•  Minimum spend: Slides subtotal must be at least $60 USD before the discount is applied.
  
  

• Shipping, taxes (other than GST), duties, and other fees do not count toward the minimum spend.
  
  

• If slides are priced below the minimum spend due to markdowns, sale pricing, or other discounts, you must add additional eligible slides products so that the slides subtotal meets the minimum spend (if permitted under section 7).
  
  

Product exclusions

• Excludes gift cards and gift card purchases.

• Any additional exclusions or category restrictions shown at checkout will apply.

• This offer is valid on full-price Slides only. 

• Excludes sale, clearance, markdown, bundle, or promotional pricing unless expressly stated.
  
  

7) Stacking / Combination with Other Offers

Unless expressly stated otherwise in writing, this offer:

• cannot be used with any other promotional code, coupon, voucher, referral discount, first-time customer offer, or similar code-based promotion; and
  
  

• may not stack with automatic discounts (including sitewide markdowns), bundles, multi-buy offers, or other promotions.
  
  

If more than one discount is available, Company may require you to choose one, or may apply the single best eligible discount, depending on checkout functionality and where permitted by law and in compliance with your consumer rights.

In the event of a system error that permits stacking in violation of these Terms, the Company reserves the right to adjust the order to reflect the intended single discount, subject to applicable law.

8) Limits (One Use / Single Use / Anti-Abuse)

• Limit one (1) redemption per Eligible Customer.
  
  

• Promotional Codes are unique, single-use, and non-transferable.
  
  

• Codes must not be shared, sold, traded, published, or distributed.
  
  

• Company may limit redemption to one (1) per customer/account/email address/household/payment method/shipping address, where permitted by law, to maintain promotion integrity.
  
  

• Any attempt to circumvent these limits may result in the discount being refused, reversed, or the order cancelled (subject to applicable law).
  
  

9) No Cash Alternative; Code Replacement

• The Promotional Code has no cash value and is not redeemable for cash, credit, or a gift card.
  
  

• The Promotional Code will not be replaced or reissued if it is lost, deleted, unused, expired, or invalid, except where required by law or where the failure to redeem is due to Company’s error.
  
  

10) Returns, Refunds, Exchanges & Cancellations

Returns and exchanges are subject to Company’s returns policy located here and applicable law.

Refund calculations

If you return all or part of an order that used the Promotional Code:

• Faulty Products (Consumer Guarantees): If you return a product because it is faulty, defective, or fails to meet a consumer guarantee under applicable law, you are entitled to a full refund of the price paid for that item. The discount will not be clawed back, even if the return drops your order value below the minimum spend.

• Voluntary Returns (e.g., Change of Mind): For voluntary returns (where permitted by our Returns Policy here: link), your refund will be limited to the amount paid for the returned item(s) after the discount was applied. If a voluntary return reduces your eligible slides subtotal below the $60 minimum spend, Company reserves the right to adjust the refund to reflect that the discount no longer applies to the retained items.

Reissue of code after returns/cancellation If an order is cancelled by you, or if qualifying items are returned voluntarily, the Promotional Code will not be reissued. If an order is cancelled due to Company error, or if a faulty item is returned, Company will reissue a code upon written request received within thirty (30) days.

Fraud and chargebacks Company may refuse refunds or limit redemptions where there is evidence reasonably suggestive of fraud, misuse, or chargeback abuse, subject to applicable law.

• If an order is cancelled by you, or if qualifying items are returned, the Promotional Code will not be reissued, except where required by law or due to Company error.

11) Technical Issues; Errors; Checkout Validation

• Company is not responsible for technical failures outside its reasonable control (e.g., payment processor outages, customer connectivity issues, device settings).
  
  

• Company may correct typographical, technical, or pricing errors. Confirmed orders will not be cancelled or materially altered except to correct obvious and substantial errors, subject to applicable law.

• The final checkout price is the agreed price. However, if an error results in you being charged incorrectly, the price is subject to correction to rectify Company errors and to protect your consumer rights.
  
  

• If a Promotional Code does not apply due to an eligibility issue, expiry, or combination restriction, the checkout price shown at payment submission will control.
  
  

12) Changes, Suspension, or Withdrawal

Company may modify, suspend, or withdraw the promotion where permitted by law, including to address suspected fraud, technical issues, or errors.

• Changes will not affect eligible orders already placed prior to the change or withdrawal. Any modification or withdrawal will apply prospectively only.
  
  

• If the promotion is withdrawn before you redeem due to circumstances outside Company’s control, Company may provide an alternative offer or remedy where required by law.
  
  

13) Privacy and Marketing

Company will process personal information in connection with this promotion (including eligibility verification and fraud prevention) in accordance with its Privacy Policy and applicable privacy laws.

• Participation in the promotion does not require you to purchase anything beyond the normal redemption conditions above.
  
  

• If you unsubscribe after receiving the email, you may still redeem the offer during the Promotion Period, provided you were subscribed at Send Time and otherwise remain eligible (unless prohibited by law or these Terms).

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising out of this promotion shall be resolved in accordance with the dispute resolution provisions contained in the Company’s Terms of Service.

2. Competition Period
The Competition begins at 12:00AM AEST on 28/04/2026 and ends at 11:59PM AEST on 02/05/2026 (“Competition Period”). All dates and times are in Australian Eastern Standard Time (AEST). Entries must be received during the Competition Period.

3. Eligibility
3.1. Entry is open worldwide to individuals aged 18 years or older at the time of entry (“Eligible Entrant”).

3.2. The Competition is void where prohibited by law.

3.3. Employees and contractors of Archies Footwear Pty Ltd and MoveActive, and their immediate families, are not eligible to enter.

3.4. Entrants must hold a valid public Instagram account to enter. Private accounts may prevent the Sponsor from verifying entries.

3.5. It is the entrant’s responsibility to ensure that participation is lawful in their country of residence. The Sponsor reserves the right to disqualify any entrant where participation would be unlawful.

4. How to Enter (No Purchase Necessary)
4.1. No purchase or payment is necessary to enter or win.

4.2. To enter via Instagram during the Competition Period, an Eligible Entrant must:
a) Follow @archiesfootwear and @moveactive on Instagram;
b) Tag a Pilates partner in the comments of the official competition post (Each winner may nominate one  (1) friend to receive the same prize pack.)

c) Comment one thing you love about your Pilates routine; enter again each day for another chance to win.

4.3. The competition will refresh everyday between 27.04.26-02.05.26 (Competition refreshes at 8-10am AEST / 5-7pm ET timing.  Entrants may submit one valid entry per day by correctly commenting on the thing they love most about their pilates routine. 

4.4. Entries must be original and submitted manually. Automated, duplicate, or bulk entries may be disqualified.

4.5. The Sponsor reserves the right to disqualify any entry that is incomplete, fraudulent, or in breach of these Terms or Instagram’s terms of use.

5. Judging & Winner Determination – A Game of Skill 

5.1. This Competition is a game of skill. Winners will be selected based on their creative responses from all eligible entries received during the Competition Period.

5.2. Five (5) winners will be selected, with one (1) winner selected per day during the Competition Period.

5.3. Each selection will take place on or about the following business day after each daily entry period.

5.4. The Sponsor’s decision is final and binding, subject to any applicable laws.

6. Prize Details

6.6. The Prize is non-transferable, non-negotiable, and cannot be redeemed for cash or any other form by credit, unless required by law. If the advertised Prize (or a part of it) becomes unavailable due to reasons beyond the Sponsor’s control, the Sponsor may substitute a prize of comparable nature and equal or greater value, subject to any applicable laws and regulatory approval (if required). The Prize is subject to the terms and conditions of the issuers (including, but not limited to, blackout dates, booking requirements and/or expiry dates).

6.7. Currency: The Prize is denominated in Australian Dollars (AUD). For winners outside Australia, the value in local currency will vary based on exchange rates at the time the Prize is issued. 

6.8. The Grip Socks Prize from MoveActive will be delivered electronically (for example, via email) to the verified winner’s nominated email address within 30 days of winner verification, unless a longer period is reasonably required due to circumstances beyond the Sponsor’s control. The Footwear Prize from Archies will be delivered electronically (for example, via email) to the verified winner’s nominated email address within 30 days of winner verification, unless a longer period is reasonably required due to circumstances beyond the Sponsor’s control. 

6.9 The Sponsor is not responsible for any costs, fees, taxes, or charges incurred by the winner in redeeming or using the Prize, including but not limited to travel to or from any hotel, accommodation upgrades, or add-on services.

7. Winner Notification & Verification
7.1. The provisional winner will be notified within 2 business days via direct message from the official @archiesfootwear account on the platform used to enter.

7.2. To claim the Prize, the provisional winner must respond to the notification within 48 hours of the Sponsor sending the notification and may be required to provide satisfactory proof of identity, age and residency.

7.3 If a winner does not respond within the required time, is ineligible, or cannot be contacted, we may award the prize to a new selected entry.

7.4 By entering this promotion, entrants acknowledge and agree that, if selected as a winner, their personal information (including but not limited to name, email address, phone number, and delivery address) may be shared with MoveActive for the purpose of prize verification and fulfillment. MoveActive will handle all personal information in accordance with its privacy policy and will use such information solely for administering the prize.

8. Publicity & Content Licence
8.1 By entering, you grant Archies a non-exclusive, worldwide, royalty-free licence (with the right to sublicense) to use, reproduce, publish and communicate your entry content (including your handle and comment) for marketing and promotional purposes relating to this competition and the Archies brand.
8.2 You warrant that your entry is original and does not infringe any third-party rights.

9. Privacy & Data Protection
9.1 Archies will collect and use your personal information only for the purpose of administering the competition, verifying eligibility, contacting the winner and delivering the prize.

9.3 Where GDPR/UK GDPR applies, Archies is the data controller and processes personal data on the legal bases of performing these Terms and our legitimate interests in administering and promoting the competition.

10. Limitation of Liability

10.1. To the fullest extent permitted by applicable law, the Sponsor and its related entities, directors, officers, employees and agents are not liable for any:

 (a) lost, late, misdirected, damaged, incomplete or illegible entries;
(b) any error, omission, interruption or delay in operation or transmission;
(c) communications line failures or network, hardware or software malfunctions of any kind;
(d) unauthorized human intervention in any part of the entry process or the Competition; or
(e) technical or printing errors in any materials associated with the Competition.

10.2. Nothing in these Terms excludes or limits any liability of the Sponsor that cannot be excluded or limited under applicable mandatory law, including but not limited to liability for:

 (a) death or personal injury caused by the Sponsor’s negligence;
(b) fraud or fraudulent misrepresentation;
(c) gross negligence or wilful misconduct; or
(d) any non-excludable statutory consumer guarantees or rights (for example, under the Australian Consumer Law or similar consumer protection laws in the EU, UK, US, New Zealand and Canada).

11. Platform Release & Compliance

11.1. This Competition is in no way sponsored, endorsed, administered by, or associated with Instagram, Meta Platforms, Inc., TikTok or ByteDance Ltd. You are providing your information to the Sponsor, not to these platforms.

11.2. By participating, you fully release Instagram, TikTok and their parent companies and affiliates from any liability arising out of or in connection with this Competition, to the extent permitted by law.

11.3. You must comply with all applicable platform terms of service, community guidelines and rules when participating.

12. General
12.1. The Sponsor reserves the right, subject to applicable law and any necessary regulatory approvals, to modify, suspend or terminate the Competition if fraud, technical failures or any other factor beyond its reasonable control materially impairs the integrity, fairness or proper functioning of the Competition. Where this occurs, the Sponsor will use reasonable efforts to notify entrants and may select a winner from eligible entries received up to the date of suspension, where fair and lawful to do so.

12.2. These Terms are governed by the laws of Victoria, Australia, without prejudice to any mandatory consumer protection or other non-waivable rights that apply in your country, state or province of residence. To the extent of any inconsistency between these Terms and such mandatory local laws, the local laws will prevail for residents of that jurisdiction.

12.3. If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
