Archies Footwear Gift Card Terms of Service - US

These Terms of Service (“Terms”) govern the purchase, use, and redemption of Archies Footwear digital gift cards (“Gift Cards”) issued for use in the United States.

By purchasing or using a Gift Card, you agree to these Terms. If you do not agree, please do not purchase or use a Gift Card.

1. Definition of Gift Card

Gift Card
A digital gift card is a prepaid, stored-value card that can only be redeemed through the Archies Footwear US website:

Non-transferable
Gift Cards are non-transferable and cannot be redeemed for cash except where required by law.

2. Validity Period

Gift Cards do not expire.

However, after five (5) years of inactivity, unused balances may be subject to applicable state unclaimed property (escheatment) laws.

3. Fees

No Fees

Archies Footwear does not charge dormancy, maintenance, or inactivity fees on Gift Cards, as required under applicable U.S. federal law.

4. Redemption

Online Use
Gift Cards can only be redeemed on the Archies Footwear US website by entering the 14-digit code at checkout.

Multiple Transactions
Gift Cards may be used across multiple purchases until the full balance has been used.

Purchases Exceeding Balance
If a purchase exceeds the available balance, the remaining amount must be paid using another accepted payment method.

Restrictions on Purchase

Gift Cards cannot be used to purchase other Gift Cards.

Archies Footwear may refuse, cancel, or hold any Gift Card transaction if fraud, misuse, or suspicious activity is suspected.

Checking Your Balance

To check your Gift Card balance, please visit our website or contact customer service.

5. Refunds and Faulty Cards

Faulty Gift Cards

If a Gift Card is defective or issued incorrectly, you may be entitled to a replacement or refund under applicable federal or state consumer protection laws. Please contact customer service for assistance.

No Refunds

Gift Cards are non-refundable and cannot be exchanged for cash, except where required by law.

Refunds to Gift Cards

If you return a product purchased using a Gift Card, any refund will be returned to the original Gift Card.

If the Gift Card cannot be reloaded, Archies Footwear may issue a replacement Gift Card for the refunded amount.

6. Liability

Limitation of Liability

Archies Footwear is not responsible for any loss, theft, damage, or unauthorized use of a Gift Card after it has been delivered (including via email or digital wallet), except where required by applicable law.

Lost or Stolen Cards

If a Gift Card is lost or stolen, please contact:

Proof of purchase may be required. Replacement is not guaranteed and may be provided at our discretion.

Incorrect Information

Archies Footwear is not liable for errors arising from incorrect information provided during purchase or redemption (including incorrect email addresses).

Technical Issues

Archies Footwear is not responsible for delays or failures resulting from technical issues, including email delivery delays or website errors.

Gift Card Value

Archies Footwear is not responsible for discrepancies in Gift Card value unless caused by our error.

Force Majeure

Archies Footwear is not liable for failure to perform obligations due to events beyond our control, including natural disasters, system outages, or government actions.

7. Payment Methods for Gift Cards

Excluded Payment Methods

Gift Cards cannot be purchased using Buy Now, Pay Later (BNPL) services, including but not limited to:

  • Klarna

  • PayPal Pay in 4

Archies Footwear may cancel any Gift Card transaction attempted using BNPL payment methods.

8. Privacy and Data Security

Archies Footwear is committed to protecting your personal information in accordance with applicable U.S. privacy laws, including:

  • California Consumer Privacy Act (CCPA)

  • California Privacy Rights Act (CPRA)

  • Other applicable state privacy regulations

Any information provided during Gift Card purchase or redemption will be handled according to our Privacy Policy.

Consumers also retain the right to request that businesses do not sell or share their personal information where applicable under law.

9. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles, except where preempted by U.S. federal law.

Any disputes will be subject to the jurisdiction of federal or state courts located in Delaware.

Archies Footwear may update these Terms to comply with changes in applicable law. Updated Terms will be posted on our website, and continued use of the Gift Card constitutes acceptance of those changes.

10. State-Specific Gift Card Terms

(a) Expiration and Fees

Gift Cards do not expire and are not subject to any fees.

Pursuant to the New York Gift Card Act, gift cards issued for use in New York:

  • have no expiration date

  • are not subject to post-purchase fees

This policy complies with, and in many cases exceeds, the requirements of U.S. federal and state law.

(b) Cash Redemption Requirements

Where required by state law, we will provide cash redemption upon request for remaining balances below the applicable threshold.

Examples include:

  • California: balances under $15

  • Colorado: balances under $5

  • Maine: balances under $5

  • Massachusetts: balances under $5

  • Montana: balances under $5

  • New Jersey: balances under $5

  • Oregon: balances under $5

  • Washington: balances under $5

(c) Unclaimed Property Compliance

Archies Footwear complies with applicable state unclaimed property laws governing unredeemed gift card balances.

11. Fraud Prevention

To help protect consumers from scams, we provide mandatory gift card fraud warnings.

All purchasers must review and acknowledge a fraud prevention notice before completing a gift card purchase, as required by laws in certain U.S. states.

States including California, Maryland, New Jersey, New York, Rhode Island, Delaware, and Nebraska require specific consumer warnings regarding gift card scams.
